TERMS AND CONDITIONS

Payment Terms
  1. Payment terms are:
    • 1/3 deposit with order
    • 1/3 7 days pre-delivery/commencement
    • balance on completion less 5% of the full contract total, this 5% due 28 days thereafter.
  2. No firm delivery date can be agreed prior to placing an order and payment of deposit.
  3. In event of failure to comply with the payment terms, ASPF reserve the right to charge interest on outstanding payment at 5% above the Bank of England Base Rate.
  4. The quotation is exclusive of VAT.
  5. Day work rates (for return visits/extra works);
    • All ASPF operatives will be charged at £30.00 per hour
    • For return visits: rates to be agreed prior to the work being carried out.
    • Accommodation will be charged at cost plus £25 per day per person subsistence allowance.
    • Mileage will be charged at 45p per mile.
  6. Prices are based on daytime working and having continual work at all times. Should there be a requirement for an unscheduled break in fixing, or night work, additional costs will need to be agreed in writing.
  7.  Extra work can only be undertaken after written, costed instruction by client.
  8. ASPF shall retain the ownership of the materials until full payment has been received for them.
  9. Prior to receipt of full payment, ASPF may (without prejudice to any of its other rights) retake possession of the materials or any part of them.
  10. This quotation is based on current rates for labour and materials and is open for acceptance for 12 weeks from the date of the quotation and will be subject to negotiation thereafer.
  11. Completion payment is due on completion of the final acid wash after application and NOT when the pool has been commissioned. The retention payment is due 28 days after completion.
Technical / Finishes
  1. The pebbles are natural stone and will contain variations of colour and shading. These colour and shade variations are one of the highlights of a natural pebble pool finish and are not considered to be a failure.
  2. Aqua Stone Pool Finishes Ltd (ASPF) will inspect the site once, free of charge, prior to commencement
  3. Pebbling – max thickness 10mm
  4. If the finish is to be square and parallel, this should exist prior to the pebble application. Any making good or corrections can be made using sand/cement render either by ASPF or others, at additional cost.
  5. If pool elevations are to be plumb or any falls are required, this must be clearly stated to ASPF pre-order and provisions made to amend with sand/cement render or screeds, either by ASPF or others. If this is not carried out the pebble will follow the contour of the concrete.
  6. Due to the nature of the pebbling process, there might be a slight unevenness/waviness to the final finish. This will be barely noticeable when below water level. Any walkways or beach areas may be susceptible to slight puddling.
  7. Day work joints are inevitable on pools but these are barely visible once the pool is filled.
  8. Any Settlement cracks appearing after initial application of pebble will not be the responsibility of ASPF and rectification will be at additional cost (materials and labour).
  9. Pebble applications are not flexible, any movement beneath the material may cause the finish to crack or delaminate. ASPF can take no responsibility for this.
  10. Some loss of stone is expected, especially in a new installation, it is not to be considered a failure.
  11. Any repairs undertaken to the pebble finish by Aqua Stone may result in some cosmetic variation.
  12. Minor surface crazing may occur under certain conditions but this is a natural occurrece and is not considered a failure.
  13. Some pool finishes may contain sea shells such as Abalone and Mother of Pearl. The shells are made up of material from sea water and from a living mollusc. Due to circumstances beyond our control, such as the nature of shell materials and variables of water chemistry, Aqua Stone cannot guarantee the lasting integrity of this shell material against degradation and loss of colour.
  14. Some pool finishes may contain glass and although the surface may glitter when dry and in light/sunshine, the appearance may lose some/all of this effect when under water.
  15. A pebbled pool is an “exposed aggregate” finish and the surface is textured and has a “bumpy” feel. However, be aware that there is no surface in any pool that you can spend several hours playing volleyball and not get abrasions on your feet.
Requirements
  1. Pool and spa shells must be entirely dry pre-pebble ie. no water ingress.
  2. The ground water table should be established and proper provision made to reduce the hydrostatic pressure around the outside of the pool shell by clients’ contractor. It is impossible to pebble pools with water entering the pool shell. As a guideline, the pool should be dry from ground water for a period of 7 days prior to commencing pebbling. This guideline is set out to ensure that the condition of the pool is stable and the ground water conditions are being controlled. Whilst the first activity during the pebbling process is to dampen down the pool, this is only to help the adhesion of the pebble.
  3. If the pool is outdoors, provision may be needed to cover the pool and a separate quote for tenting is available. This cost is currently excluded.
  4. If motorised pool cover is specified, pool walls must be square and parallel pre-pebble.
  5. Surface/substrate to be pebbled must be sound and left slightly rough to ensure good adhesion of pebble. Surfaces will be inspected 7 days prior to pebbling to ensure suitability. If, at any time, post pebbling, it is found that the surface/substrate has either blown or moved, no responsibility will be taken by ASPF unless preparation work prior to pebbling has been undertaken by ASPF themselves.
  6. The pool shell should be clean and free of debris and any contaminants ie. exposed re-enforcing, timber etc.
  7. The main contractor to provide complete protection of any finished/completed work against physical damage, moisture, soiling, contamination and staining. (This includes the finished pebble surface).
  8. The copings and/or freeboard must be in situ and secure prior to pebbling and the adhesive should have cured.
  9. The programme should allow for our works to be completed before the final cleaning of the building.
  10. The main contractor to supply safe, dry and secure storage for our materials, preferably in one place for the duration of our works.
  11. The main contractor to supply hoisting facilities to upper and lower floors, if relevant. Also, safe, manual access for transportation of materials to site of works ie. side of pool.
  12. The main contractorto supply water, electric light and power (240V and110v) for our works, in close proximity.
  13. Any requirement for heating/gas blowers as a result of low temperatures should be provided by the main contractor.
  14. The main contractor to supply any scaffolding required for our work.
  15. The main contractor to supply toilet and First Aid facilities.
  16. At least a 3 bar water pressure must be available to enable pressure washing of pebble.
Pool Care Guidelines
  1. As with any other finish, it is important to maintain the correct chemical balance within the pool water as set out by industry guidelines. pH and Calcium levels are particularly important in preventing scale from building up on the finish. Whilst filling the pool and prior to filtration, it is recommended that the pool is swept daily. By brushing, any debris in the water will be suspended and eventually captured by the filter.
  2. Aqua Stone recommends that pool owners "balance" their pool water using the "Langelier Saturation Index" (chart found at http://www.whitmer.com/saturation_index.htm). This system takes into account pH, alkalinity, water temperature, chlorine and calcium hardness. We recommend that for the first 30 days pH and alkalinity be monitored regularly as they can directly affect the appearance of the surface. It might help to maintain levels of pH, alkalinity and calcium hardness toward the lower end of the index. Keep in mind, based on your water source, you may need to add "Muriatic acid" to your new pool 2 to 3 times per week during the first month. After 30 days, the pool should be checked 1 to 2 times per week and adjusted accordingly. If your finish is a darker colour, in particular black, it is even more important that you follow these instructions. Do not chlorinate your pool until water is filtered and pH and alkalinity are acceptable. Chlorine is highly reactive and can cause metals or minerals to precipitate (cloud water, scale and/or stain). A number of pool supply retail stores have computerized testing equipment to help you monitor these factors as well as others (cyanuric acid, metals, etc.). 
  3. Recommended water chemistry guidelines:
    • pH 7.4 – 7.6
    • Alkalinity 80-120ppm
    • Calcium Hardness 200 -400ppm
    • Guidelines for water balancing and chemistry given by Aqua Stone are only RECOMMENDATIONS.
  4. Responsibility for water chemistry remains with the pool builder/servicing engineer/client and will vary from region to region. A written record should be maintained.
Other
  1. No liquidated damages will be agreed.
  2. These terms and conditions form an integral part of our offer and take precedence over any other conditions where they are in conflict.
  3. Pools should be filled immediately after pebbling has been completed to avoid the pebble becoming soiled. Any marks caused as a result of the above not being adhered to will be the responsibility of others. In addition, the filling of a pool will aid the equalising of outside pressure due to water tables etc.
Warranty
  1. Any warranty does not include service, cleaning or repair of a finish that has been abused or not properly maintained.
  2. Calcium deposits (scaling) from corrosive water or staining from foreign material in the pool are excluded by our warranty.
  3. Any costs relating to water replacement, chemicals and loss of use of the pool are excluded by our warranty.
  4. Surface crazing or cracking caused by structural movement or damage are excluded from the warranty.
  5. Any warranty is non-transferrable and is only valid to the client/contractor issued with the warranty.
  6. Any warranty is not valid until Aqua Stone have been paid in full.
